Harassment

Harassment occurs when a person (A) behaves in a way that is unwanted and connected to certain protected characteristics (like age, gender, or race) towards another person (B). This behavior can be considered harassment if it:

  1. Violates B’s dignity, or
  2. Creates an environment for B that feels intimidating, hostile, degrading, humiliating, or offensive.

Harassment can also involve unwanted sexual conduct or behavior connected to gender reassignment or sex. If this behavior causes B to be treated worse because they rejected or accepted it, it’s still harassment.

When deciding if behavior counts as harassment, it’s important to consider:

  • How B perceives the behavior,
  • The situation as a whole, and
  • Whether it’s reasonable to think the behavior would have this negative effect.

The protected characteristics that are considered under this law include:

  • Age
  • Disability
  • Gender reassignment
  • Race
  • Religion or belief
  • Sex
  • Sexual orientation

Bullying

Bullying is offensive, intimidating, or malicious behavior that involves the misuse of power, aimed at undermining, humiliating, or threatening an individual.

It can make the target feel vulnerable, upset, or degraded.

Unlike legitimate management actions, bullying is characterized by persistent and unjustified actions intended to cause distress or harm, though it may also involve single severe incidents.

Power in bullying can stem from authority, personal strength, or the ability to coerce through fear or manipulation.
